There are two things people are typically told when they are going to be on the witness stand:

1) Just tell the truth and everything will be fine

Telling the truth is good advice. Expecting everything to “be fine” is a good way to get blindsided! It isn’t nearly that simple. I am a strong advocate of telling the truth both from a moral point of view and from a practical one. (The odds of being caught out in a lie are high, and the consequences are very unpleasant.) However, the opposing lawyers are trained to find the weaknesses in your story, or make what was logical and real sound far fetched and unbelievable. True, for the most part, the “disagreements” in any proceeding are “legitimate differences of opinion between men of good will” and the court is supposed to address them as such. But, it is certainly possible to tell the truth without being convincing (just as there are convincing liars). Remember, it isn’t just a matter of telling the truth, it is much more importantly a matter of getting the judge and jury to believe you.

2) Say as little as possible

There is much to be said for this advice, the less you say, the less chance there is that you will say something wrong. Indeed, the opposing lawyer’s most potent weapon is the awkward silence. People often want to be helpful and, being uncomfortable with silence, they will say something, anything to end it, which often means they say something they shouldn’t.
However, if you don’t say anything, you don’t strengthen your side’s case either. The court will make a decision based on what people say in testimony, so, if you don’t mention something important, it won’t help your case.

The important “trick” is to say all of the right things, and none of the wrong ones. But, also to make sure you say it in the most believable way possible. This book is intended to help you do just that. And to do it in such a way that the judge and jury will believe you.

Whether you are a profession witness, a witness in a criminal or civil case, or even in a divorce or child custody battle, this book will help you feel comfortable and more importantly help your side to win in whatever legal case you find yourself involved in.
